3DS MAX 9 and FS9/X?

Is it true that there is currently no way to use 3DS MAX v9 with either game pack?

Not that I know of. The last I heard, the Aces team were using Max 7. They might have upgraded to 8 now, not sure. I've heard of people getting 8 to work well with the FSX exporter, but nobody that I know of has had success with 9.

Yes, that is correct. The gamepack with the SDK only works with version 7 or 8.
