• Which the release of FS2020 we see an explosition of activity on the forun and of course we are very happy to see this. But having all questions about FS2020 in one forum becomes a bit messy. So therefore we would like to ask you all to use the following guidelines when posting your questions:

    • Tag FS2020 specific questions with the MSFS2020 tag.
    • Questions about making 3D assets can be posted in the 3D asset design forum. Either post them in the subforum of the modelling tool you use or in the general forum if they are general.
    • Questions about aircraft design can be posted in the Aircraft design forum
    • Questions about airport design can be posted in the FS2020 airport design forum. Once airport development tools have been updated for FS2020 you can post tool speciifc questions in the subforums of those tools as well of course.
    • Questions about terrain design can be posted in the FS2020 terrain design forum.
    • Questions about SimConnect can be posted in the SimConnect forum.

Any other question that is not specific to an aspect of development or tool can be posted in the General chat forum.

By following these guidelines we make sure that the forums remain easy to read for everybody and also that the right people can find your post to answer it.

MSFS24 Creating payware license aircraft

Greetings! Is it legally permissible to develop and commercially distribute models of existing certified aircraft for Microsoft Flight Simulator without obtaining a license or written permission from the rights holder to use the aircraft’s design, appearance, trademarks, and brand name? How do small studios or solo developers release licensed aircraft in the marketplace - do they actually pay royalties to the manufacturer, or is there another mechanism that allows them to do so?"

" do they actually pay royalties to the manufacturer, or is there another mechanism that allows them to do so? "

The legit ones do exactly that, or at least get permission, Royalties arent 'required' just permission

there is no mechanism that allows indi or small devs, or anyone for that matter, to commit Piracy

the only thing that 'allows them to do this' is ...
companies that hold rights simply cant afford to chase everyone, and for a small indi they may not be able to even recover the legal fees just to get a Cease and Desist order
so they tend to only go after bigger companies with more sales, or for small stuff that may make their product/service look bad

that does not make it right to do so, its still Piracy

disclaimer
Im not a lawyer and that is just an Opinion

FSDeveloper doesn't give legal advice, and we don't condone discussions about it. If in doubt, seek a lawyer, and act in a manner that protects yourself.
Sending a letter or email to a company to get permission doesn't take much effort. A YES answer is a yes, and anything else is a NO.
